The Protection Of Farmers’ Land Rights And Interests From The Perspective Of Government Accountability

Rural land circulation is an inevitable trend of urbanization.As the speed of land circulation continues to increase and the scale continues to expand,how to effectively protect the land rights of landless farmers has also become a serious problem.The government who holds the national administrative power can Regulating land market operations through the operation of public power.It plays an important regulatory role in land circulation.This paper which takes the farmer’s land rights and interests as the research goal take the government responsibility as the perspective to study how to protect the landless peasants’ rights and interests.The paper used a comprehensive analysis methods,comparative research methods and interdisciplinary research methods as the conducted to analyze the current state of land rights of landless peasants.Exploring the correlation between the fulfillment of duties by the government in regulating land circulation activities and the realization of farmers’ land rights and interests.Finally,the paper propose relevant suggestions for the problems that the government has in the process of performing its duties.The government should adhere to the idea of serving the people.The government responsibilities mainly include four aspects.In rural land circulation,the government should perform legal responsibilities,administrative responsibilities,political responsibilities,and moral responsibilities and insist on safeguarding the land rights of landless peasants.Now,although the current peasants’ land rights and interests have been greatly improved.But it cannot be denied that the situation of landless peasants losing their land rights is still within a certain range.The existence of this problem was related to the government duties.As a legislator,the government’s legislation on peasant land issues still lags behind the actual need to protect peasants’ land rights.For example,the definition of “public interest” is unclear.From the perspective of administrative responsibilities,the government is on the land.In the circulation,land trades cannot be well supervised,the initiative of services is insufficient,and the lack of response to peasants’ interests is lacking;in terms of political responsibilities,the lack of accountability mechanisms for political responsibilities,the removal powers of the power organs are set aside;As a result,some government administrators have low moral standards and lag behind in moral cultivation.The existence of these problems directly leads to the loss of the rights of landless farmers.The rights of landless peasants’ land can not be realized without the government’s role.It requires the government to effectively perform related duties according to law.The implementation of government responsibilities should not only learn useful experience from abroad,but also proceed from the current situation of peasants’ land rights and interests guarantee,adhere to the principle of being lawful,open,and giving priority to farmers’ rights and interests,speed up the process of the legalization of land circulation.Speeding up the revision or improvement of relevant Laws and Regulations.Strengthen the supervision of land circulation,enhance the initiative and responsiveness of performance of duties.effectively promote the implementation of government administrative responsibilities.Playing the role of party organizations and power organs at all levels and establish the accountability mechanism for government political responsibilities.Building a clean government,improve the professional ethics training mechanism and raise the professional ethics level of government administrators.
