Research On The Legalization Of Technical Investigation In Our Country

In the current "criminal procedural law" in China announced,although the basic framework of the system of technical investigation was built,but some of these ideas in the legislation of fine performance was not prominent thus,resulting in China's existing technical investigation system still exist many loopholes.This paper fully considered while the basic principle of technical investigation in our country,an investigation is fully considered,the status of implementation of the practice,and put forward some feasible suggestions in the repair process,the better for the legalization of technical investigation in our country.In addition to the introduction and the conclusion part,there are four parts in this paper.The first part is the subject of the introduction of the concept of China's technical investigation and the necessity of the construction of the rule of law in technical investigation.The second part by summarizing our country's technology investigation legal process.Discusses the problems in the system of technical investigation in our country,and expounds the actual situation of technical investigation under the background of the new law of criminal prosecution and the analysis of the reasons for the existing problems in China's technical investigation system.The third part is to discusses the principle of the rule of law of technology investigation in China.The fourth part is to refer to the experience of the mainstream legal countries outside the region.To explore the legislative design of technical investigation of the rule of law in China,including technical investigation right configuration,technical investigation scope and conditions of the implementation period,technical investigation for the implementation of the program,reform of the technical investigation system of public security organs.the technical investigation received information and use illegal processing and technical investigation behavior sanction mechanism and remedies.
