Empirical Research On The Social Probation System Of Juveniles In Yinchuan

Juveniles are the future and hope of the society.The juvenile criminal justice should weaken the function of punishment,strengthen the function of education and rescue,and pay more attention to the function of protection and prevention.This is also consistent with the value concept of "non criminalization,non imprisonment and light punishment" for juvenile criminal justice advocated by the international community.But the pursuit of the non imprisonment of the juvenile penalty and the socialization of the execution of the penalty does not mean simply putting it in the society.In order to achieve the purpose of education and remedy,the construction of the related system is particularly critical.Under this background,the juveniles' social probation system came into being.Because of its key significance to the juvenile criminal justice,it has gradually evolved into one of the indispensable and important systems for the criminal justice of the modern juveniles.In our country,due to the late start of the juvenile justice system in our country,it has not formed a systematic and perfect system of juveniles' social probation.It is in the transition from the budding period of the juveniles' social probation system to the development period.Therefore,it is necessary to study the system of the social probation of the juveniles.The juvenile court of Yinchuan Xingqing District People's court and the riminal procuratorial department of juveniles in Xingqing District,Yinchuan,are authorized by the superior procuratorate and the court,and have jurisdiction over the procuratorial and judicial work of the juveniles Yinchuan.And the Yinchuan Municipal Administration of justice manages the probation of juvenile delinquents.Therefore,after discussing the related concepts of the social view and protection system of juveniles,this paper makes a survey of the above three organs and analyzes the embodiment and existing problems of the concept of the present juveniles' social probation system in their work and the society of the juveniles in Yinchuan.The construction of the view protection system gives reasonable suggestions.
