Research On The Standardization Of Investigation And Forensics From The Perspective Of Crime Prevention

The existence of unjust cases is a cancer of society,it not only hurts the judicial justice,but also bring irreparable pain to the parties.Based on the study of more than 260 major criminal cases,the author selects 30 representative cases and shows them chronologically in tables in order to find out the main reasons for the generation of misjudged cases in investigation and evidence collection: gathering evidence by torture and extortion methods;not collecting evidence comprehensively,especially evidence of innocence or misdemeanor;lacking verification in key evidence;making mistakes in verbal evidence and authentication opinions and other misconducts in evidence-collecting.Thus,the author arrives at the countermeasure system of criminal misjudged case in investigation phase: to standardize investigation and asking work by implementing the whole process of recording,the management of the places of custody,and the exclusionary rule;to regulate the inspection and identification work by ensuring the legality in the process of authentication and the interpretation of authentication opinions;to reinforce supervision by strengthening internal audit and outside monitoring system.In a word,only by improving the ability of the obtainment of evidence and investigation can the public security office ensure to prevent and control miscarriage at the source.
