| As a kind of Internet sharing economy service model,Internet Vehicle was first appeared in China in the summer of 2012.XiaoJu Technology was established and launched the APP(Dripping Predecessor)APP;FastSmart Technology was established and launched a quick taxi.APP;both APPs provide users with taxi online calling service.2016 is a key year in the development of the online car industry.In July,the Ministry of Communications and other seven ministries issued the highest-level departmental regulation “Interim Measures for the Management of Online Appointed Taxi Business Services”(hereinafter referred to as “Interim Measures”).The Interim Measures "")confirmed for the first time the legal status of the Internet.At this point,China became the first country in the world to legalize the Internet.Subsequently,local governments across the country have successively introduced local temporary measures to refine the "Interim Provisions." In early January 2018,the People’s Government of Kunming City successively issued two local red-headed documents entitled "Implementation Opinions" and "Provisional Measures" of the Kunming government regulations [2018] No.1 and No.2.There are a lot of highlights in the "Provisional Measures" that are worthy of our study,and the corresponding effects are worthy of our expectation.The basic structure and content of this article are as follows: The first part introduces the background of this topic,the current status of the problem,the innovation point of the thesis and the research methods,etc.The second part is the analysis of the related problems involving the vehicle about the network,mainly expounding the network about the car.Concepts and characteristics,network appraisal classification,operational procedures,the nature and status of the network appropriation vehicle platform,and the legal relationship between the parties involved in the subject,etc.,provide the basis for the following arguments;the third part elaborates the online dating industry.At present,the problems highlighted include the chaotic positioning of online platforms,the role of all parties involved in the service,the unclear responsibilities of status,and the inability of the insurance system to play a good role in protection.The fourth part is to propose legal solutions to the above problems.The method,mainly as a network carrier vehicle platform company as the carrier,assumes the liability for the first-line payment,and does not form joint liability with the driver.The insurance company optimizes the settings of different types of insurance;the fifth part is a summary of the full text. |
