Research On Criminal Classification System In Chinese Prisons

Prison is responsible for punishing and transforming criminals.It is an important sign of whether a country is civilized or not,and whether the legal system is advanced or not.The construction of a modern prison criminal classification system is conducive to the promotion of the stable operation of the prison management mechanism,and thus to improve the quality of the correction of the offender,greatly reduce the criminal rate of re crime,to ensure the smooth execution of the penalty to provide a strong guarantee.The classification of criminals is characterized by the guidance of "teaching by people"and has a strong practical significance.Therefore,it is one of the main contents of the reform to explore the theory of prison and deepen the study of the criminal treatment in the world.The criminal classification system is an important feature of the modern prison construction.It is not only a complex penalty execution technology,but also to a certain extent it is considered as one of the symbols of the level of the national criminal correction and development.Whether a country's criminal classification system is complete or not determines the accuracy of the division of criminals in the country.In western countries,the classification system of criminals has been developed for a long time,the basis and conditions of all aspects have been improved,and a complete set of classification procedures and implementation standards have been formed.Most of the research on the criminal classification system in China remains in the traditional practice research which relies on the practice of summarizing and expanding the research.It has not yet formed a sound theoretical system,and is limited to the internal execution of the prison,a penalty executing agency,and lacks in-depth discussion.From the long-term legal practice,we find that the so-called "retribution punishment" has a high degree of identity in the hearts of the people of our country,so in the legal field,people are more heated to study the criminal classification of criminals,and are more heated to the precise conviction and sentencing,in contrast,criminals who have entered the penalty stage of punishment are required to establish the criminal.The classification system has not been paid much attention to,which indirectly leads to the classification of criminals which should be guided by the category of prison science.Because of the lack of theoretical basis,it has to be classified and classified according to the classification of crime.Based on the work experience of China's prison management for nearly ten years,the author tries to systematically introduce the present situation of the classification of Prison Criminals in our country,and expounds the short board of the current criminal classification system,and points out the current simple and extensive classification system of criminal offenders and the improvement of the quality of the correction of criminals in China.To reduce the inappropriate situation of the re crime rate in the reversion society,it is confirmed that the system has reached the urgent need to improve.This paper,taking the criminal classification system in the modern prison system as the core of the study,focuses on the link between the theory of educational punishment,the theory of socialization of penalty execution and the individualized theory of penalty execution,aiming at ramming the theoretical foundation for the optimization of the current criminal classification system in China.The author tries to take the concept of criminal classification system and practical operation,the history of the classification and evolution of criminals in the western countries,the different points of the criminal classification system used by the Chinese and Western countries,the shortcomings of the criminal classification system in China and the suggestions for the reform of the criminal classification system,and the current crimes at home and abroad.Crime classification system and theory are compared and analyzed,so as to provide some ideas for improving our current criminal classification system.
