On The Reform And Perfection Of The Community Correction System In China

Community correction originated in the West.It originated in England in nineteenth Century.It was designed to transform and rectify young people who might return to society.This system shows the glory of humanitarianism and reduces the probability of two crimes committed by prisoners.Therefore,this system is widely used in western developed countries.In China,the community correction system began in 2003.After 15 years of continuous development,it has achieved good legal effects and social effects.By the end of 2017,3 million 701 thousand members of the community serving prisoners had been received in all parts of the country,with a cumulative relief of 2 million 940 thousand people and more than 76 thousands of prisoners in the community.As the most important regulatory force of community correction,the grass-roots community correctional institutions are increasing,the pressure and responsibility of supervision are increasing,and a series of practical problems are encountered.Some problems are quite universal and representative.Based on my own working experience,the author takes the basic community correction mechanism in China as the research perspective,and selects Shaxian County,Fujian Province as a sample,and makes a thorough investigation on the situation of community correction in the county,and obtains a large number of first-line information,and puts forward the corresponding summary,induction and analysis in combination with the theory and practice.This article is divided into three parts.The first part is the basic theory,which introduces the legal basis of the basic community correction system,and analyzes the basic theory of the community correction system,such as the modesty thought of the criminal law,the theory of penalty evolution,the theory of socialization of execution,the theory of penalty economy,and the function of the community correction system in our country and the function of the community correction at the grass-roots level.The value is discussed.The second part is the sample survey and empirical analysis,taking Shaxian County of Fujian Province as the survey sample,introducing the basic situation and the practice effect of the community correction work in this county,combining the basic theory,focusing on the fuzzy and power loss of the law enforcement bodies exposed by Shaxian County community correction work,the deficiency of the social investigation evaluation,and the change of the social investigation evaluation.There are six outstanding practical problems in the difficulty of residence,the supervision of the special community,the education correction and the formalization of public welfare work,the individualized correction and the absence of psychological correction,and the deep reasons are made from the lag of the legislation,the incompatibility of ideas,the poor coordination,the lack of guarantee,the poor supervision and the lack of social support.Analysis and discussion.The third part is the countermeasures and suggestions,focusing on the guiding ideology of improving the level of social governance"socialization,rule of law,intellectualization and specialization",which is put forward by the nineteen major reports of the party.In view of the practical problems and causes of the analysis,the top level design is combined with the concrete practice at the grass-roots level,and a complete legal and institutional system is constructed.In order to bring some reference value to the practice and research of community correction work in the grass-roots community,some suggestions are put forward to guide the community correction and cooperation with intelligence,to strengthen the fund guarantee,to build a professional team,to effectively supervise the prisoners in special communities and to improve the social level of community correction.
