Research And Application Of Unfair Competition In Enterprise Management

This paper simply introduces the position and function of the anti-unfair competition law in the enterprise.Through empirical research,qualitative analysis,quantitative analysis and experience methods of studying on the cases which are unfair competition in the domestic and some other countries,the paper analyze the case classification,case time,case of court official document,ranking case of accepted court,case region and case of success and failure and the proportion of the losing case.Through analysis on fail case,the paper concludes that:1,important and difficult points on unfair competition and trademark law;2,Application of unfair competition,trademark and criminal law on suit case.Through classification and infringement analysis on foreign enterprise case,for example America,Canada,UK and Australia,the paper concludes that:China should learn some ideas from these foreign cases in different countries.The analysis resolve five problems which are faced by enterprise in China.The end of this paper is the suggestion on unfair competition management in enterprise.
