Research On The Insufficiency Of Guiding Function Of The Guidance System Of Criminal Case

The effective operation of criminal case guidance system helps to adjust judges' referee's thinking,standardize the discretion of judges,ensure similar cases' dispose and maintain judicial justice.But at present,the guiding function of the system is not enough.It is mainly due to the lack of extensive effect in criminal cases,the discrepancy in the referee's thinking,the restriction of the existing judicial system,and the ambiguous operation effectiveness of Guidance system of criminal case,which lead its effect is not optimistic.Therefore,we should gradually strengthen the persuation of judgment,and improve it through the application of differentiating technology,encouraging referee' quote of guiding cases,and establishing guiding effectiveness.
