Further Discussion On The Legalization Of Euthanasia In China

The legalization of euthanasia is not a new topic.From the beginning of the Wang Mingcheng case in 1986,all walks of life have been discussing the issue.But with the development of China’s economy,the aging society and the changing social concepts are coming,I still believe that the re study of the problem has profound theoretical and practical significance.Although some countries have confirmed the legality of the act in the form of law,our country still criminalized the crime of murder with lesser punishment.Students think that how to regulate euthanasia is a question that our legal people should consider,rather than one-size-fits-all.This paper is divided into four chapters.The first chapter is the introduction,mainly introduces the research background of this thesis,purpose and significance,research status at home and abroad,this thesis research methods and research contents;the second chapter introduces four cases of brain death,and cross comparison for these cases confirm the concept and scope of euthanasia,euthanasia;the third chapter describes the presence of in reality,the legalization of euthanasia problems;the fourth chapter mainly introduces the method of how to promote the legalization of euthanasia.Finally,combined with the reality,the problem of euthanasia in China is brought to the track of law.In the first place,this paper discusses the real dilemma,including medical ethics,traditional concept,existing legal system and medical security system.And from the point of view and logic,we should make a reasonable discussion on these issues,so as to eliminate people’s concerns about the legalization of euthanasia.At last,the author puts forward the progressive path of legalization of euthanasia,including the first step of the transition of the actual punishment to the special relief mode.The second step is to develop non-criminal and non-criminalized treatment modes.Thus,the ideal status of euthanasia is legal.
