On The Indigenization Path And Method Of Annotation Legal Research Paradigm

Legal research is the need to learn from foreign legal ideas.In contemporary Chinese legal studies,we must be good at applying advanced legal ideas to examine some deficiencies of our legal system.The Annotation School of Law is an important school of thought in the history of western law.Researching the proposition of"annotation legal research paradigm" has a strong theoretical value and application value.Annotation law and legal hermeneutics,legal interpretation system is more natural,but the legal scholars have always been less research in this area.Therefore,the research on issues such as "annotated legal research paradigm,relationship between annotated jurisprudence and legal hermeneutics,relationship between annotated jurisprudence and Chinese legal interpretation system,and localized approach and method of annotated legal research paradigm" is necessary and Strongly innovative.This paper attempts to study the explanatory paradigm of annotated jurisprudence and annotated jurisprudence from the perspective of the legal interpretation system with Chinese characteristics,to examine China’s legal interpretation system and legal hermeneutics,and to study the "research paradigm of annotated jurisprudence",focusing on improving China.From the angle of the legal interpretation system,it focuses on the legal topic of "An Approach to the Approaches to Localization of Annotated Legal Research Paradigm in China" and hopes to find a localization approach and method for the annotated legal research paradigm.First,the research background and significance of the theme of the "localization approach and method of the annotated legal research paradigm",the current research status,the main ideas and innovations of the research are briefly introduced;then,from the "Annotation Law Overview,Annotation Law The contribution of the school,the research paradigm of law,the research paradigm of commentary law,etc.,and the study paradigm of Annotation Law were studied.Later,it introduced China’s legal interpretation system mainly from "China’s legal hermeneutics and annotated jurisprudence,the institutional design of the Chinese legal interpretation system,the current status of China’s legal interpretation system,and the necessity of perfecting China’s legal interpretation system".Several aspects introduced the need for the reform of the Chinese legal interpretation system and the Chinese legal interpretation system.China’s legal interpretation system has an inseparable relationship with China’s legal hermeneutics.From the perspective of the Chinese legal interpretation system,to study the localization path of the annotated legal research paradigm,we must demonstrate the relationship between annotated jurisprudence and Chinese legal hermeneutics.Therefore,I discussed China’s legal interpretation from the following aspects:"China’s traditional legal interpretation and commentary law,Chinese modem law transformation and commentary law,Chinese Marxist law and commentary law,and Chinese contemporary legal interpretation and commentary law".Relationship with annotated law.Finally,it focuses on discussing the specific path of perfecting the legal interpretation system with Chinese characteristics from the perspective of the localization of the annotated legal research paradigm.Mainly from the "comprehensive adaptability of the law research paradigm localization,the development of legislation in China to carry out legislative work,the setting of specific rules" and other aspects were carried out.Among them,for the "setting of specific rules",because of its strong application value,the focus has been expanded and in-depth demonstration.Mainly from the perspective of"improving the system of legal interpretation with Chinese characteristics",it tries to find the specific path and method of annotating the paradigm of Chinese law.
