The PPP model,also known as the cooperation between government and social capital,is a project operation model in which the public sector and the private sector provide infrastructure and services for the public.In this model,the private sector is encouraged to actively cooperate with the public sector and participate in the provision of public goods and services to meet the needs of the public.This will not only help to relieve the financial pressure of the government departments,increase the utilization rate of China's fiscal funds;but also help to increase and improve the supply of public goods and services,give full play to the decisive role of the market in the allocation of resources and the regulatory role of the government,and improve the comprehensive governance governance capacity of our country.As an important measure for China to deepen structural reforms and promote the transformation of government functions,the PPP model has made considerable progress in China in recent years,the State Council and its ministries attach great importance to the implementation of PPP projects,to this end,various policy documents have been issued to promote PPP model.Although the current development trend of PPP is strong and its unique advantages have been favored by government departments,there are still many problems in practical operation.For example,the operation of the project itself is not open and transparent,the market order is chaotic;the supervision is insufficient,the credibility of government is low;the project is inefficient,and so on.At the same time,government departments,which are important parties in the PPP model,also have overlapping conflicts in policy making,the role of government departments is ambiguous,and there is a lack of cooperation and supervision mechanisms,PPP leading organizations compete for project leadership.The author believes that the main reason for the above problems lies in the lack of unified PPP legislation,several government departments compete for the PPP's legislative and decision-making dominance for their own interests,especially the Ministry of Finance and the National Development and Reform Commission,the frequent publication of the red-headed documents of their own departments and their own PPP project pools,which leads to the inability of the policy implementers;in addition,the lack of regulatory mechanisms among various departments and weak awareness of cooperation have also caused related problems.These bad relationships can easily lead to low administrative efficiency and weakened government credibility,the financial risks and the cost of social operation will also increase,the PPP model cannot play its due role.It is one of the necessary measures to improve the PPP model by regulating the relationship between government departments and changing the bad state of PPP operation.The idea of regulation is mainly analyzed from the legislative point of view,including improving the PPP legislation,that is,accelerating the improvement of PPP's own legislation and related laws and regulations;establishing a PPP cooperation group between government departments as China's PPP management agency to form a long-term cooperation mechanism between departments,to clarify the division of responsibilities of the departments,to harmonize and manage the related matters of the PPP;establishing the Ministry of Finance as the PPP supervision department in China,not only can make the PPP government departments and the private sector to carry out scientific and effective supervision from the horizontal point of view,from the longitudinal angle,which but also can make the Ministry of Finance play a greater role in the supervision of funds in the process of the management of the PPP project.The above ideas have important and positive effects on regulating inter-department relations,adjusting the role of government departments in the operation of PPP,rationalizing the cooperation model among various departments,and promoting the sound operation of the PPP model.This article is divided into six parts.The first part is the introduction,which briefly introduces the existing problems of PPP model and its development process in China,leads to the topic that will be discussed below;the second part focuses on the analysis of the role orientation of our government in the PPP model and the division of labor between the various government departments from the theoretical level;the third part examines the relationship between the government departments of China in the PPP model from the practical level and finds out the outstanding problems in the relations between the government departments by examining and analyzing the situation of the government departments in formulating the PPP policy documents;The fourth part analyzes the reasons and adverse effects of the unfavorable relationship among government departments in the PPP model;The fifth part is the center of the full text and the end result,it puts forward the basic idea of legislative regulation on the relationship between government departments in the PPP model;the sixth part is the conclusion,summarizing the core ideas of the full text.
