The increasing innovation and reform of mobile internet technology provides impetus for the generation and development of shared economy.Sharing economy with a brand-new business innovation mode,constantly penetrating and integrating with various social industries,In the context of " internet plus" and shared economy,to promote the network car hire which is a typical sharing economic model.In recent years,the rapid development of online taxi service provides an opportunity to solve the problem of taxi difficulty and to some extent relieves the problem of taxi difficulty.At the same time,sharing economy provides conditions for the allocation of market-oriented resources in passenger transport industry to some extent.But there is no denying that the rapid development of online car hire service is also accompanied by some problems.At present,the supervision system of online car hire is still not perfect,and there are some problems in the implementation of supervision policies in local areas.Leading to a certain degree of confusion in the network car market order,it is imperative to establish an institutionalized regulatory system.Based on the current development and supervision situation of China’s online car hire service industry,this paper compares and draws lessons from foreign experience and combines with the actual development of China’s online car hire.Put forward corresponding countermeasures for China’s network car hire system supervision,in order to be beneficial to the development of China’s online car hire service industry and form a win-win situation among consumers,industries and society.This article is divided into five parts to explain the problems studied:The first part of this article mainly discusses the network car and its operation mode in theory,this paper introduces the concept of network car hire and its four operation modes,mainly includes the access platform mode of traditional cruising cars.Quartet agreement mode,platform self-operation mode and private car access platform mode,And further analyzes the causes and necessity of network car hire.Through theoretical analysis,we have a preliminary understanding of the network car hire.The second part of the article introduces the supervision process of China’s online car hire,it mainly includes early exploration stage and standard development stage.At the early stage of exploration,discussions were mainly focused on the legality of network car hire.At the later stage of development,discussions are mainly focused on how to standardize the supervision of online car hire.Further leads to the problems existing in China’s regulatory system,the existing problems in supervision are analyzed from five angles: supervision philosophy,supervision legislation,supervision process,supervision measures and supervision responsibility.The third part of the article mainly investigates the supervision system of foreign network car hire from the perspective of comparative law,including the United States,Britain,France and Singapore,through comparative analysis,foreign network car hire supervision have their own characteristics:The regulatory model represented by the United States,based on the characteristics of online car hire,creates a new online car hire regulatory platform,reducing government intervention;The regulatory model represented by Britain is to bring online car rental into the category of private car rental,and to establish the government regulatory platform,which restricts the regulatory model of drivers.The supervision model represented by France,bringing the online taxi into the cruise taxi category,And implement strict market access policy for it;The regulatory model represented by Singapore,though implementing strict market access policy,has formulated perfect supporting measures.The supervision modes of foreign network car hire have their own characteristics,which has certain reference significance for China’s network car hire supervision.The fourth part of the article focuses on the analysis of the considerations of China’s network car hire supervision,Firstly,it is the choice of supervision objects,and the author suggests taking the network car platform as the main supervision object.Secondly,it is the choice of regulatory principles,and the author suggests that moderate regulatory principles should be adopted in the supervision of online car hire.Finally,it discusses the choice of supervision mode of network car hire in China,and emphasizes the advantages of diversified mixed supervision.The fifth part puts forward the optimization suggestions of China’s network car hire supervision.Through the main problems of China’s supervision put forward in the second part and the reference of foreign experience in the third part,combined with the considerations of supervision factors in the fourth part,summed up a set of network car hire supervision scheme in line with China’s national conditions,put forward suggestions from four angles: The transformation of regulatory philosophy,the improvement of regulatory legislation,the construction of regulatory system and the implementation of regulatory responsibility.In order to provide institutional guarantee for the healthy and stable development of China’s network car hire industry.
