The Study Of Cross-examination And Authentication On The Expert Opinion In Criminal Trial

With the continuous development of social and economic levels,criminal crimes have become increasingly complex.Therefore,criminal judicial appraisal has become an important means to find out the truth of crimes and to find out the facts of cases.A large number of criminal appraisal opinions have also been used as evidence in court trials.However,from the perspective of the review of several unjust,false,and wrong cases that have shocked the country in recent years,although the main reason is not the abuse of criminal forensic appraisals,the issue of cross-examination and authentication of criminal appraisal opinions has been exposed.This article focuses on the current China’s criminal appraisal of cross-examination and certification system,and put forward some perfect suggestions.This article is mainly divided into five parts:The first part is the introduction of this article.It mainly introduces the source of this topic,its theory and practical significance,the research status of related topics,and the innovation of this paper.The second part is the summary of criminal appraisal opinions.It mainly analyzes the concept,nature,status and characteristics of criminal appraisal opinions,and further demonstrates the necessity of cross-examination of criminal appraisal opinions.The third part is the analysis of the status quo of cross-examination and certification of our country’s criminal appraisal opinions.It mainly introduces the current judicial status and problems in our country from the aspects of cross-examination,certification and related supporting systems of criminal appraisal opinions.The fourth part is the inspection of the identification of expert opinion in the foreign criminal trials.The article examines and evaluates the cross-examination of the cross-jurisdictional opinions of the two legal systems,and analyzes the pros and cons of cross-examination procedures for criminal appraisal.The fifth part is the proposal to improve the process of cross-examination and accreditation of criminal appraisal in China.It is mainly based on the assimilation and reference of the merits of the system of criminal appraisal and certification of two legal systems.The certification procedure is recommended.
