Research On The Pakistan Foreign Investment Law

The free flow of capital elements in the international community is an important driving force for economic globalization.With its abundant foreign exchange reserves and its solid financial strength,China is gradually shifting its role from a host country to investment country.Under the new round of demands for economic structural readjustment and upgrading,China urgently needs to expand outward.Furthermore,at present,the international geopolitical and economic situation is becoming increasingly complicated.The intervention by the western forces in our peripheral areas has obviously increased.Moreover,in the face of the new economic situation and the international situation,China has proposed "Belt and Road," "China-Pakistan Economic Corridor" and other strategic ideas.Pakistan is an important investment destination for China in South Asia.Since independence,Pakistan has been actively absorbing and utilizing foreign investment,solve domestic financial difficulties and develop the domestic economy,and continuously revised and adjusted its Foreign Investment Law and formulated a relatively complete legal system for.This paper will research on the FIL of Pakistan,through three issues about admission of foreign investment,foreign treatment,foreign investment protection.Finally,the paper hopes to provide practical help to Chinese investors who intend to enter the Pakistan market by the research of FIL.In addition to the introduction and conclusion,this article includes five parts.The first part is an overview of Pakistan's foreign investment law.It mainly introduces the development process and legislative model of foreign investment legal system in Pakistan.At the same time,it introduces the legal sources of Pakistan's foreign investment law from two angles of domestic law and international law,and comprehensively grasps the characteristics of Pakistan's foreign investment law,laying a solid foundation for the latter part.The second part studies the legal issue of the admission of foreign investment.Based on the basic theory of the admission of foreign investment.On the one hand,writing the approve rules in the bilateral investment treaties and free trade agreement which are signed by Pakistan.On the other hand,writing the content of the admission of foreign investment including the scope,the conditions and so on.The third part mainly discussed the foreign investment incentive in Pakistan.It is including tax treatment,land concessions,Industry and area offers and other treatments,at last,national treatment will be a standard to evaluate the the foreign treatment in Pakistan.The fourth part is about the foreign investment protection in Pakistan.Firstly,it studies the problems of remittances,expropriation,nationalization and similar measures of foreign investors.Secondly,it focus on Pakistan's dispute settlement procedures,so that investors can seek out help when disputes happened and finally make comment on it.The fifth part is the influence of Pakistan's foreign investment law on Chinese investors' in Pakistan and the countermeasures.This part settled in China,first introduced the current investment status of Chinese investors in Pakistan,followed by an analysis of Pakistani foreign investment law impact on Chinese investors to Pakistan investment,and finally stood in the perspective of Chinese investors to put forward countermeasures.
