Study On The Protection Of College Students’ Part-time Labor Rights In Hainan

At present,with the rapid development of the social economy and the Internet,various network platforms provide college students with a very convenient part-time mode.Part-time university students have gradually become a common phenomenon.Off-campus part-time work is an important part of the college students’ access to economic income and practical experience.However,with the increasing popularity of part-time students outside the university,there have been endless cases of infringement of their personal and property rights without effective relief.Theoretically,there are few regulations concerning the protection of labor rights of college students as an employment group,because there is still controversy over the participatory status of college students as part of the main body of labor and the labor relations with employers.In the course of part-time work,when the labor rights and interests are infringed,the Contract Law and The Tort Liability Act are mostly used to resolve the dispute,instead of the Labor Law and the Labor Contract Law,which in many cases makes college students part-time.There is no effective remedy for infringement of labor rights.Therefore,it is of great significance to study the protection of labor rights and interests of such a representative and increasingly large employment groups.The article is divided into four parts.The first part:The basic status quo of the infringement of part-time labor rights of undergraduates in Hainan Province.Questionnaires and conversations were conducted to investigate and analyze the status of the infringement of rights and interests of college students during the part-time employment in Hainan Province.The second part:The main problems in the protection of part-time labor rights for college students in Hainan.Through the analysis of the results of the first part of the investigation and study,we find out the problems existing in the application of labor law and judicial practice for the protection of part-time labor rights for undergraduates in Hainan.The third part:The relevant theories of foreign university students’ part-time labor rights protection and the reference significance to our country.Through the relevant provisions of foreign students’ rights and interests in part-time labor protection,the reference to the protection of China’s labor law is proposed.Part IV:Suggestions for improving the protection of part-time labor rights for college students in Hainan.Based on the above analysis,suggestions are made from the aspects of legislation,judicature,schools,employers and part-time university students.
