Research On Guardianship Supervisor

In order to prevent the Guardian from abusing the rights,many countries revise the guardianship system and supervise the guardianship of guardians by setting up the guardianship supervision system.This system has become the current trend of guardianship legislation in most countries.Although the law of our country regulates the guardians ' rights and interests,but the content is summarized and the lack of concrete implementation rules,the effect of judicial practice is not great,and the Guardian tort incidents occur.This paper intends to provide useful suggestions for perfecting the mechanism of guardianship supervision in China by analyzing the experience of the overseas supervision Supervisor's legislation and combining with the beneficial discussion of domestic scholars in this aspect.In addition to the introduction and conclusion,the text contains three chapters.The first chapter briefly introduces the concept of guardianship supervisor,analyzes its value,and then discusses the methods and responsibilities of guardianship Supervisor and adult guardianship supervisor respectively.And finally the writer makes a comparative analysis of these two types of guardianship supervisors.The second chapter expounds the present situation of legislation and judicature of Guardianship Supervisor system in our country and puts forward some reflections.The third chapter,based on the experience of extraterritorial legislation and the actual situation in China,discusses the significance and realistic basis of perfecting the guardianship supervisor in our country,and provides suggestions for improving the guardianship system.
