The Agreement on the Implementation of Sanitary and Phytosanitary Measures(SPS Agreement)developed under the WTO framework is an important document regulating the international trade in agricultural products.Its mission is to regulate the proper use of SPS measures.The implementation of risk assessment is a prerequisite for the application of SPS measures and therefore one of the core elements of the SPS Agreement.The trade in genetically modified foods is booming in the international trade of agricultural products.Genetically modified foods due to technical uncertainty and various parties on political and social considerations,the risk assessment system to apply a lot of uncertainty.First,it is manifested in the disagreement over the key elements when the dispute settlement body applied the SPS Agreement risk assessment system to related cases.Second,under the SPS Agreement risk assessment system,differences among countries on the system of GMO risk assessment.With the development of international trade,the risk of genetically modified food itself also flows among the international community.The global nature of this risk determines that the construction of a risk regime should always be global in nature.Therefore,it is necessary to clarify the related concepts in the risk assessment system of SPS Agreement,to interpret the relevant disputes and to seek the path of institutional optimization.A possible innovation of this paper is the systematic analysis of this particular area of genetically modified foods under the umbrella of the SPS Agreement risk assessment system.Based on the original risk assessment system,we will seek the best route for the application of genetically modified food.
