Parents Punish Behavior Of The Criminal Law

There's been a lot of social problems with parents education in recent years.There is a lot of discussion about the education method and education method.The differing opinions have led to a different assessment of parental discipline.The evasion of the law also led to resistance to the judgment of parental punishment.Judicial judges often fail to comprehensively evaluate the disciplinary actions of parents in specific cases.n order to break the state,both protect the legal rights of minors and protect parents' education responsibilities.In this paper,the author makes a study on the criminal law of parental punishment by reading and understanding the related literature.Firstly,the disciplinary action of parents is defined and comprehensively defined.On the basis of the analysis of the legal status of the parent disciplinary action,the author makes a reasonable distinction and evaluation on the exercise of the parental punishment behavior and the abuse of the parental punishment behavior.Finally,it provides some Suggestions and reflections on the realistic legislation of parental punishment.The hysteresis of criminal law has two influences on the evaluation of behavior.One is that the behavior can be defined as the transformation between crime and undefined crime.The second is that behavior is gradually taken into the system by not being judged by the criminal law.Parents punish ACTS of nature,the current law and not to evaluate such special behavior,make this kind of behavior is not specialized,at the time of specific evaluation,will be difficult to conform to the concept of fair and justice of criminal law,and the current social situation in China in terms of criminal law,the crime rate will decline gradually,goes into a minor criminal law,the existing types of regulations about the act being exempted from behavior will gradually adapt to the development of the society,not the parents will punish behavior of such super regulations legitimation for can maintain the stability of the penal code,case and justice.Admit that parents' disciplinary actions is in order to protect the minors,when parents abuse punishment,the parents still need to bear legal responsibility.
