Citizen Participation In Taiwan Human Biobank Legislation And Its Enlightenment

The human biobank is an emerging biological technology that records information on living habits,environmental factors,clinical medicine,and biomarkers,and tracks long-term participants' health status and conducts interactions between disease genes and the environment.This study can explore the pathogenic factors of common diseases in the region,and provide scientific basis for the prevention,diagnosis and treatment of diseases.Therefore,it has attracted the attention of countries or regions in the world.This article elaborates the status quo of the construction and legislation of biobank in typical countries abroad and in Taiwan,compares and contrasts the similarities and differences in laws and regulations in different regions,and analyzes the legitimacy,background,and basic principles of the Taiwan biobank legislation.Secondly,it explains the preconditions,approaches,and significance of the participation of citizens in Taiwan's biobank in legislation,as well as Taiwan's efforts and achievements in ensuring citizen participation in legislation.Finally,we summarized the enlightenment of Taiwan citizens' participation in the legislation of the biobank and its reference to the mainland.The first part is about the origin of the topic.A comprehensive analysis and comparison of the status quo of legislation on the construction of biobank in foreign countries,mainland China,and Taiwan,sums up the ethical dilemmas and legislative models that countries face in the process of their construction,and uses the "Saliva Incident of the Kavalan Indigenous Peoples" in Taiwan.As an example,it elaborates on the difficult decision-making and legislative problems that may be encountered in biomedical research,and points out the basic principles that must be followed in the legislation of biobank.The second part deals with the issue of citizen participation involved in the legislative process of the Taiwan biobank.Citizen participation legislation,as an important form of citizen's political participation,can fully and directly reflect the will of the people.It is of great significance for advancing the construction of democracy and the rule of law and improving the quality of legislation.Its purpose is to realize civil rights.In the process of ensuring citizens' effective and full participation in legislation,the promotion of civic education and the establishment of citizen trust are essential.The third part is the inspiration and reference.Taiwan's progressive legislative strategy in the legislation of the biobank,the civic participation that attaches great importance to legislation,and the beneficial practice of improving citizens' participation have brought a lot of enlightenment to the legislative work of the mainland biobank.Its useful experience is worth learning from.
