Research On Investigation And Evaluation Of Community Correction

The investigation and evaluation of Community Correction can provide a basis for comprehensive judgement of whether the non-custodial penalty applied to defendants and criminals is in conformity with the value of public security,whether it is conducive to the correction of their criminal mentality and behavioral abuses,prevention of repeated recidivism,and whether they can achieve effective supervision and so on.The implementing agencies shall be understand the overall situation of correctional personnel,formulate correction plans in a targeted way.Article 4 of the Implementation Measures for Community Corrections is the applicable basis for China’s community corrections survey and evaluation.Because of its low legal level,the regulations are general,and the practicality is not strong,Issue arose in practices of community correction survey and evaluation.It needs to be further studied and put forward sound ideas.This paper is divided into three parts,a total of about 23,000 words.The first part is a theoretical overview of community correction survey and assessment.According to Article 4 of the “Community Correction Implementation Measures”,Analysis of the starting method,starting subject,executive subject,and investigation and evaluation content of community correction survey and evaluation are analyzed.It is proposed that the community correction investigation and evaluation is a county-level judicial administrative agency that is entrusted by the people’s court,the people’s procuratorate,and the public security authority.To investigate and understand the personal dangers,social hazards and corrective conditions of defendants and criminals who intend to apply community corrections.Investigate the formation of assessment opinions submitted to the commissioning agency.Analyzing the pre-procedures,social investigations,and personality surveys concerning the nature of community corrections,the essence of the community corrections investigation and assessment is the integration of surveys and assessments,and the investigations serve evaluations.The pluralism of crimes,the theory of personal danger,and the socialization of execution in the new school of criminal law theory are the basis of the correctness of the community correction survey and evaluation system.The second part is an empirical survey of the community correction investigation and assessment in X County of Sichuan Province.Through the analysis of the Sichuan Province Investigator Investigative Score Table,the Criminal Investigation Opinion Score Table,the X County Community Correction Institutions,and the team construction situation,community corrections survey and assessment related data in recent years,this paper point out that the community correction survey and assessment exist the problem of unclear institutions and personnel,lack of professionalism,inconsistent content,single measure,procedurally rough procedure,insufficient time frame,and lack of scientific standards.The existence of these practical problems greatly restricts the in-depth development of community correction practice,and it needs to be taken seriously on the basis of revealing problems.The third part is suggestion for community correction investigation and evaluation.In response to the questions raised in the second section,it is suggested that the investigation and evaluation should be set up in the procedure as the community correction pre-procedure,the time of investigation and assessment is not included in the review,and the reasoning and feedback system for the establishment of non-trusted assessment opinions should be established;By vertical management,construction survey and evaluation of professional teams,survey and evaluation of social workers set into tstaffing of government affiliated institutions;in the content of the scientific setting of personal risk prediction factors and the ratio of personal risk and correction conditions,classification according to the type of crime applicable survey assessment scales,clear surveys and assessments of the types and quantities of respondents,and so on,provide a feasible guarantee for the standardized operation of community corrections.
