Study On The Historical Rights Of The South China Sea Under The Perspective Of "Geng Lu Book"

The South China Sea islands and the sea near them have been an inalienable part of China’s territory since ancient times,this is also the consensus of the international community.In recent years,Some countries around the South China Sea have continuously claimed sovereignty over the sea areas and islands and reefs related to the South China Sea while sending troops to occupy and control parts of the islands and reefs.These acts have seriously violated the territorial sovereignty of the South China Sea in our country.The intervention of some extra-territorial powers also made the South China Sea issue more complicated and more international in its development.As a part of customary international law,historical rights have many successful cases in settling territorial disputes.Taking historic rights as the legal basis for settling the dispute over the South China Sea is of great significance to resolving the dispute over the South China Sea."Geng lu book" is the guide of the South China Sea fishermen’s experience in the production and life of the South China Sea Islands and seas.The existing versions of the"Geng lu book" detailed the names of the islands and reefs in the South China Sea and how to get to these islands and reefs,the routes,distance and features of the islands,which is an important folk proof to show our historical rights to the South China Sea.The naming of the island reefs and sea areas reflects our country’s sovereignty over the South China Sea.From the perspective of navigation "Geng lu book" by fishermen in the South China Sea,this paper analyzes the naming and navigation route of South Island reef recorded by multiple versions of "Geng lu book",which reflects the development of South China Sea islands fishermen in South China Sea Business history,and the naming of islands and reefs and waters was absorbed by the state and recognized by the international community,thus rising to the state’s behavior,making it an important folk evidence to prove that our country enjoys the sovereignty of the South China Sea.This article is divided into four parts,the first part is an introduction,which mainly focuses on the basis and significance of the topic selection,literature review,research methods and innovations;the second part mainly discusses historic rights,including analyzing the constitutional elements of historic rights,using them in international disputes and their status in customary international law,pointing out that historic rights are of great significance in settling territorial disputes;the third part mainly discusses the related contents of "Geng lu book",which recorded in the South China Sea Islands and the islands of the South China Sea route,named arrival,reflects the Chinese fishermen in the South China Sea Development and management behavior,to prove that our plays an important role in the history of the South China SeaRight;the fourth part mainly discusses that it is the best choice to solve the disputes in the South China Sea by using historic rights.By building a solid legal basis,we can have a legal basis for China’s sovereignty over the South China Sea.
