| Cyclical fluctuations in mid and late 1980 s,in response to the shipping market,shipping industry,employing way reform,beginning in the Labour quantity requirement is big,the low post professional knowledge and skills required to use the "engineering services.In recent years,with the increasing production and operation volume of China’s shipping industry,the demand of shipping industry enterprises for labor force is also increasing.At present,labor dispatch has become the main form of employment for China’s shipping industry enterprises,and 80% of the employees of shipping enterprises are contract employees.Labor dispatching the recruitment form,because it has the characteristics of convenience,low into nature,makes it has been widely used,and this kind of form of employment also promoted the industry of our country shipping enterprise and continuous increase of the production and business operation ability,for the development of shipping industry in our country has played a huge role in promoting.Due to its own industry characteristics of shipping industry,in the future for a long period of time,labor dispatching labor form will as its main ways of employment and continue to exist,and will present the trend of rapid development.But with the wide application of labor dispatching in the shipping industry,the dispatched laborers’ legitimate rights and interests are violated events emerge in endlessly,how to build and improve the relevant legal norms mechanism system,protect the legitimate rights and interests of the dispatched workers became the current important problem to be solved in our country.Along the "under the perspective of public management,this paper stated the background-interpretation theory,research status quo,explore the reasons,solutions",comprehensive utilization of field survey and the method of combining qualitative and quantitative research,to explore the effective ways to safeguard the lawful rights and interests of the dispatched workers.Through to the shipping industry,current situation of dispatched laborers rights and interests protection research,summarizes the main problems is the occupational safety and rights,equal rights,rights of association and professional development is difficult to guarantee,and from the law,administrative regulation,the Angle of trade union organization construction and the laborer own four causes of these problems are analyzed in detail.Last,strengthen the related legal system should start from the administrative law enforcement supervision,perfect the relevant system design,strengthening the workers sense of belonging and improve their workers’ rights consciousness in five aspects,to safeguard the rights and interests of the dispatched workers ship industry in the future effective Suggestions are proposed. |
