Research On The Limitation Of Copyright Expansion Under The View Of Public Domain

Copyright expansion and the public domain in copyright law always maintain a complementary and mutually reinforcing relationship.The public domain aims to provide creative resources for creators,and also bears the responsibility to reflect copyright.Copyright expansion is the inevitable result of copyright development,but this expansion must be maintained within a reasonable limit and scope.When the copyright protection of private rights,more than necessary to limit or even damage the social public's related rights,copyright law on the decay of the public domain consequences,not only for the encroachment of the public domain,will cause more disruptive questioning of the justification of copyright.Therefore,how to effectively balance the benign relationship between public domain and copyright expansion in the field of copyright law has become a major theoretical and practical problem in the research of copyright law.In recent years,there has been a growing demand for public domain in copyright law,but the public domain has never played a substantial role.From copyright legislation for the public sector how to find a reasonable positioning,and efforts will rise in the public domain as a method of limiting copyright expansion,we need from the network technology under the strong impact of the growing number of copyright protection,expanding the scope of copyright rights,and constantly extend copyright protection and lag behind social progress effectively put forward according to the realistic problems such as the rational use of the solution.Based on the above understanding,starting from the perspective of public domain research,we think the copyright expansion limit problem,should from the construction of copyright law on the public sphere theory,to perfect the public domain in the field of copyright legislation,set up special organizations in the field of copyright law on public maintenance,basic principle of copyright law,improve the system of fair use,standard technical measures to use behavior,set up reasonable work protection period,etc,can make the copyright to return to the right direction development,realize the copyright law in the public domain in the field of proper maintenance,then promote the spread of knowledge utilization,cultural prosperity,and promote the public interest.
