Research On International Law Mechanism To Prevent And Combat Pirate Crimes

After 2008,piracy is rampant,and the international community has been hit,but it is still gaining momentum.The embarrassing situation is worth reflecting on.The author analyzed piracy crime from the view of international law,and then the international legal basis,it may need to be improved,and province proposed set piracy,China's criminal law for chinese-foreign cooperation in combating and preventing the pirate crime normative system resources.This paper is divided into five chapters:First chapter is the introduction,through the introduction of piracy study basis,as well as to the review of existing research results,proposed under the background of the current era of piracy problems existing in the legal system,raises the necessity and urgency of the international conventions and domestic legislation,and put forward the core of this article writing.The second chapter introduced early derivative history of piracy,show rampant pirates rise process and reason,also roughly introduces the new trend of the pirate crime,serious and urgent challenges facing the international community,be badly in need of cooperation between countries to respond.The third chapter analyzed the three major international legal documents against piracy as the guidance,normative analysis existing mechanism of the international community to deal with pirates crime,elaborate the evolution of international legal system,to achieve the overall grasp the mechanism and prevention and control of the pirates.The fourth chapter reviewed the practice and characteristics of international cooperation in combating piracy in recent years,and to point out that it is still to be improved in the case of China's anti-piracy practice.The fifth chapter demonstrated the necessity of the criminal law to establish piracy,proposed to set up a separate regulations,perfecting the related provisions of Chinese law about the pirate crime,draw lessons from international experience,construct the elements and types of the crime in China's criminal law piracy.
