Research On Rehabilitation System Of Qualification Penalty

Research on rehabilitation system of qualitication penalty is based on qualifications punishment elimination system,in order to realize the victim to the social value goal,means after the victim has been sentenced to qualification punishment,punishment is performed during or after the execution punishment,its behavior is good,with repentance,conformity with the provisions of the law,the court ruling recovery is deprived of or restricted from crime and right or qualification punishment system.The system value is beneficial to the resocialization of the victim,the development research of the system of the extraterritoriality of the right of punishment is mature,and our country has not established the system of the right to torture.The text of this paper is divided into four parts,which is about 30,000 words.The first part is the "ordinal",which mainly expounds the research significance,research status and research methods of the system of the right to the right of punishment,and also summarizes the innovation of this paper.The second part is "for qualification penalty after overview",mainly through the introduction on the qualification punishment after the analysis of the evolution of power system,in turn,lead to wade qualification penalty after right concept defining the problem,and according to the related qualification punishment of property analysis,further defined the related qualification punishment after the classification of power system.The third part focuses on the "outside stakeholders qualification penalty right system in the legislation and applicable",first of all foreign related qualifications punishment right system in the legislation and theory carding summed up,and,on the outside is qualification penalty applicable condition of power system.At the same time,according to the legal consequences and revocation of the extraterritorial jurisdiction system,the author makes a personal understanding,so that the legal essence of countries outside the region can beabsorbed by our country.The fourth part is "the related qualification punishment after right system for reference and construction",has yet to establish related qualification punishment after right system in our country,on the absorption use for reference the experience of other countries' legislation,this part for the construction of related qualification punishment after right system of our country,the author proposed the camera,first analysis to set up the related qualification punishment after the rationality of the power system,and then from the legislative level how to set up related qualification punishment after right system,finally from the perspective of judicial,layer upon layer construction related qualification punishment after right system of our country.
