Research On Legal Problems About The Supervision Of Adult Duardianship System

In order to cope with the coming of the aging society,all countries have revised the guardianship system.China established the comprehensive adult guardianship system in the General Rules of the Civil Law of the People’s Republic of China in 2017.(hereafter referred to as the General Rules of Civil Law).However,the existing guardianship and supervision system of our country is not only out of line with the reality but also lags behind the advanced countries in the world.This paper makes an in-depth study on the legal problems of the Supervision of Adult Guardianship System in China.In addition to the introduction and conclusion,the text has five parts:The first part is the outline of the Supervision of Adult Guardianship System.First,it expounds the concept and nature of Supervision of Adult Guardianship System.And then it analyses the theoretical basis of Supervision of Adult Guardianship System from many aspects such as the maintenance of fairness and justice,the realization of equality in the legal sense,judicial autonomy and public power intervention.The second part analyzes the subject of adult guardianship supervision.Starting from the subject under different guardianship supervision mode,this paper discusses the adult guardianship supervision institution and adult guardianship supervisor under the two-track adult guardianship supervision mode in our country,and analyzes the qualification selection and method of the adult guardianship supervision subject in detail.The third part discusses the responsibility of adult guardianship supervision.This paper analyzes the supervision duties of different adult guardianship supervision subjects,and discusses the connection between different rights and obligations of adult guardianship supervision subjects.The fourth part discusses the adult guardianship supervision measures.The measures of adult guardianship supervision are analyzed from the aspects of information registration,regular reporting,visits and reports,and accountability and punishment.The fifth part analyzes the relevant provisions of Chinese law on adult guardianship supervision system and its existing practical problems.According to the basic national conditions of our country and the existing problems of adult guardianship supervision system,the author puts forward some suggestions on the subject of adult guardianship supervision,the duty of supervision and the measures of supervision.
