Cyber ? ?bullying is a negative production of the Internet of the information era.Its proliferation and spread continue triggering a series of extreme events.It seriously infringes upon the human rights of citizens and undermines the ecological security of the Internet.It is extremely urgent to establish a systematic regulation and comprehensive governance system to regulate cyber bullying.However,the results of horizontal comparative studies show that cyber bullying regulation is not only a domestic problem,but also a problem for the international community.Most of the exploratory bills and supervisions in western developed countries have a little effect.The fundamental reason is that cyber bullying is a new type of social risk in the information age.When faced with virtualized,open,and anonymous Internet behaviors,the old-style legal and regulatory systems are easy to face the practical difficulties of high regulatory difficulty,high enforcement costs,and difficulties in implementing accountability.Therefore,a new legal system and Regulatory system to deal with new social risks should be explored.China has not yet established a new type of legal and regulatory system to deal with cyber ? ?bullying.The existing legislation and regulation are still at the initial stage,and there are many legislative vacancies.This has led to difficulties such as privacy protection,advance prevention and control,jurisdiction of cases,infringement determination,and regulatory costs.In order to solve this problem,we should learn and absorb useful experience from abroad and build new cyber ? ?bullying regulations that conform to China's national conditions,focusing on solving the problem of the absence of violations identifying standards,the immature collaboration mechanism of inter-departmental law,and the unscientific and opaque division of supervisory bodies responsibilities,achieving the regulatory effect of comprehensive supervision,timely enforcement,accountability and cost savings and finally,a new system of systematic regulation and comprehensive governance system for cyber bullying will be established.Specifically to say,China should establish a linkage governance mechanism based on administrative law,which supported bycivil law,criminal law,and various social forces,and establish a set of mechanisms that can guide different legal departments,agencies and social departments to cooperate.That means that we must first establish the standards for the identification of violations for accurately quantify cyber bullying.Second,according to the criteria for identifying infringements,a multi-tiered disposition and coordination system shall be established between the legal departments,government departments and social departments,and the supervisory responsibilities of the network information agencies and public security network administrators at all levels shall be implemented.Finally,the primary regulatory responsibility of network service providers must be clarified,and the statutory mandatory standards for the management of network services and user information must be established.At the same time,the extensive supervision role of social entities such as enterprises,schools,and families should be fully utilized.By establishing a new legal and regulatory system,improving the role of the law,improving the efficiency of law enforcement,the “last mile” barriers for the regulation of cyber bullying will be clear up,the further proliferation of cyber bullying will be curbed,and the solid foundation for maintaining the Internet ecological security,building the well-to-do society in an all-round way,building a socialist country under the rule of law will be deployed.
