Research On The Legal Issues Of Sex Transactional Administration

The ancients said that food and sex is the nature of human beings,sex and food are the basic human needs,from which we can see the importance of sex.In fact,the history of the existence of sex trading itself is long.However,countries in the world have different attitudes.In recent years,the demand for the legalization of sexual transactions in the form of prostitution has become louder and louder.Although the reasons for this are justified,they are also worthy of careful deliberation.The author wrote this article for two purposes.The first is to investigate the involvement of prostitutes prostitution administrative intervention,and called for the prostitution of prostitutes in the face of punishment should also be the same rights and interests.The second is to analyze the system of admission education and analyze whether the system infringes the citizens' right of freedom and thus strengthens the introspection of the system.This article is divided into three parts.The first part is the basic theory,which introduces the concept of sexual transaction and its harm,defines what is the difference between the administrative treatment of sexual transactions and the criminal penalties of sexual transactions,introduces the legislative attitude of all countries,analyzes the reasonableness of the legislation of sexual transactions administrative processing.The second part is the analysis of the status quo and the predicament reflection.This part analyzes the establishment and operation of the law of sexual transaction from two aspects of static and dynamic.It considers that the system of detention education system is misplaced.There are also unclear standards for the application of the standard.The third part is an investigation of the system of extraterritoriality.The part examines and introduces respectively the legal systems of the administrative transactions of sexual transactions in the United States,Japan and Germany,and summarizes the highlights of the system that can be used for reference.Furthermore,it is proposed that the current handling system should be perfected,that detention education system is no longer applicable,that it should be repealed and that new ways should be found.
