Research On The Sealing Of Criminal Juvenile Records In China

In theory,there are two main purposes for applying juvenile records,one is for punishment and the other is because they are going to,somehow,decrease crime.Records of juvenile offenses are to be kept confidential in order to give youth a meaningful chance at rehabilitation.But such records can follow an individual into adulthood,thus creaitng barriers to success.Even after a criminal case is disposed of and a period of incarceration or probation is completed,individuals who have become involved in the criminal justice system often face a myriad of collateral consequences based on their criminal records.In oder to promote reintegration and combat recidivism,our state has take legislative actions to ease the burden associated with having a criminal record.In recnetly years,these efforts have led the state to established a thorough and balanced approach to criminal record sealing.Juvenile records sealing,which is discussed by the society,is an essential ingredient of juvenile judicial system.While juvenile records sealing should be improved and developed because it is at the early stage.With literature analysis,based on the brief introduction to background and present situation of Juvenile Criminal Sealing in China,the paper proposed some suggestions for better implement of JCS in order to improve it.Chapter ? briefly identified two basic concept of Juvenile Criminal Sealing.First,we clarified the definition to criminal record,which is different from previous conviction;then we march to the contrast between criminal record sealing and previous conviction deletion.We intended to explicit the feature of Juvenile Criminal Sealing in China,especially its peculiarity with similar systems in other countries.Chapter ? analyzed the necessity of building Juvenile Criminal Sealingin China,in four aspects.First,it's necessary to enhance the fight against juvenile crime since the situation is severe at present.Second,building Juvenile Criminal Sealing accords with the protective judicial notion and policies tending to combine leniency with rigidity.Third,it benefit juveniles when they go back to the society,which promote their psychology development.Fourth,Juvenile Criminal Sealing maintained the security and stability of our society,with crime punished and the justice realized.Chapter ? analyzes the current status of China's Juvenile Criminal Sealing,by introducing the background of the system building,then the activating pattern,the applicable targets,the content to be sealed,the potency of the Sealing.And then point out the deficiency of such system in nowadays time according to the analysis.Based on the former analysis,Chapter ? is to present 5 suggestions on improving China's Juvenile Criminal Sealing System.NO.1,accuralizing the applicable targets;NO.2,build the platform of the juvenile crime information,which could be accessed and shared nationally;NO.3,clear and define the activating program and pattern;NO.4,strengthen the assorted laws and regulations;NO.5,establish a supervision system for the Juvenile Criminal Sealing,and define the relief channels.
