Research On The Network Insurgent Discourse In Conflict Justice Issues

The development of technology and new media technology in Web2.0 era promotes the diversity expression and complex narration of network public opinion.As the representative of the new media platform,Micro-blog and We-Chat have achieved the traditional meaning of the right to deconstruct and splitthrough the free production and sharing of information.The common people gradually mastered the skills of discourse generation and communication,and became an important part of social change.The discourse writing of cyberspace reflects the standpoint and viewpoint of public opinion to some extent.The most active time in general is related to urban violence enforcement,official corruption,serious environmental pollution and contradiction between doctors and patients and other events,especially in recent years,when the verdict of the judicial case does not conform to the people's psychological expectations,it forms a series of conflicting judicial issues.In these conflicting judicial issues,public opinion will show a blowout trend,which impliedthe complex components of discourse struggle and contention of discourse power.The rapid formation of the field of public opinion helps to the formation of this insurgent discourse.The insurgent discourse of judicial judgment is an important part of public opinion about lawsuit,andis the key link in the process of building the rule of law.The insurgent discourse is the important concept of western environmental communication,andthe important existence outside the dominant discourse of society.The subject of insurgent discourse has the underlying resistance color,identity structure,and with strong persuasive rather than informative.The development of the new media has given the new era characteristics of insurgent discourse:universal,complexity and online struggle.From the "Xia Junfeng case",this paper sums up three forms of confrontation,identity confrontation,emotional confrontation and conceptual confrontation,and two rules,heavy moral appeal over law demands,heavy the facts of the case over the legal facts.Its origin is that there is a negative relationship between the mass thinking and legal thinking,and the contradictions between substantive rule of law and formal rule of law.Of course,insurgent discourse in conflict justice issues also has positive and negative effects,the balance of these two aspects is an important way to build a good judicial environment and reshape the credibility of the judiciary.
