In recent years,economic globalization leads to the globalized crime.All aspects of living and other fields are inseparable from the network,and the lacking of self-protection knowledge online leaves spaces for criminals to take advantages of it.Although the popularity of computer in our country left behind the developed countries,since joining the international internet,today as one of the fastest entity of economic development in China,the high-speed development of the network to make our country gradually entered in the internet society.At the same time,the criminals use the computer as a tool to do some of the traditional crimes.The cybercrime poses a serious threat to many aspects,such as information technology,national security,civil rights,the commercial secret and so on.An emerging division of law-enforcing department which is “Internet Police”,arising at the historical moment.They have become an indispensable launch and mystery kind of police.In 2015,according to the data of Internet Emergency National Center,the overall security situation in our country of public network is smooth,located in the territory of the Trojan and botnet control keep declining.The security of mainstream mobile app store improved markedly,but the personal information leakage such as phishing is still an upward trend in the number of security incidents.Trojans and botnet control outside the country appeared to be more than domestic for the first time.The popularity of cybercrime along with the development of technological tools,team commit crime the division of professional,cross-regional crime increasingly obvious,bringing many difficulties and opportunities to network law enforcement.From the perspective of dialectic,speed of the perfection of legal system and enforcement mechanism can't always keep up with the footsteps of the changes forms of cybercrime.Law enforcement information opaque factors inevitably produce conflict between the citizens and internet police,social conflicts.In spite of this,people from all walks of life stress and lack of enforcement of network has become the supervision of the law enforcement departments,and to improve the work mechanism of power as soon as possible.In our country,the government put restrictions on the internet.The internet police once found inflammatory statements,online porn sites,fraud information,they shall ban the harmful content in the first place,crack down on internet crime and maintain security of public information.In addition,whether this young team would be able to calmly deal with many practical problems,is worth our deeply thinking.An experienced internet police said that the proportion of the cases in our country formally put on record and final result are very low over the years,even there are many cases that the victim considering other factors did not reported;On the other hand,the workload is very large,adding many burdens on physical and mental health of internet police.The causes of these problems including the misuse of law enforcement of the internet police,and competence unknown and administrative systems,the lack of social industry cooperation and so on,which make the law enforcement working harder.Firstly,the lack of law enforcement network specification,a lot of loopholes exist in laws and regulations system which will be in the investigation and evidence collection,evidence and arrest link up against the wall;Secondly,the law enforcement standard of the public security is not transparent,causing the network cannot supervised by social and law enforcement process.It reviews that permissions and the rationality of the law enforcement will be questioned;Thirdly,the prevalence of local protectionism,the domestic administrative system constraints and international cooperation restrictions make the process of law enforcement which is not strong safeguard;Finally,the limited funds,science and technology,shortage of manpower resources,network law enforcement for tracing and combat efficiency of crime is faced with obstacles.Only discussing the present dilemmas that internet police is facing with,learning from the basis of conclusive experience to perfect legislation,making clear boundaries of internet police power,fairing the process of law enforcement.We will be able to improve the level of law enforcement,to bring up reasonable suggestions to strengthen the responding capacity of internet police and the efficiency of solving cybercrime cases,to ease the burden on the internet police shoulders effectively.
