A Study On The New Types Of Theft

According to the Amendment Ⅷ to Criminal Law,commits burglary,or steals or pickpockets with a lethal weapon had be specified as the basic offenses of theft.Together with large amount and commits theft repeatedly,they have be five basic offenses of theft.These types of theft are newly developed,and they do not have minimum on amount and times,so they be called new types of theft,to distinguish them from the traditional types of theft.It have be six years long since the new types of larceny been made.What’s more,the Supreme People’s Court and the Supreme people’s Procuratorate had announced the Interpretation of the Supreme people’s Court and the Supreme People’s Procuratorate on Several Issues concerning the Application of Law in the Handing of Criminal Cases of Theft to interpretation some exist problems.But there still have many problems.In 2016,the supreme court had announced a paper to explain some legal concepts,which are related with Theft.And it should be discussed whether those explanations could be applied to Theft.So,we have to interpret three new types of Theft.This paper includes three parts:The first part has three sections.The first section has discussed the conception of indoor;second section talked something about which behavior could be called invade the door and the last section had discussed in which situations,could the Theft be transformed to robbery.The second part was include parts.The first part discussed the distinguish of the pickpockets with a lethal weapon and loot with a lethal weapon;the second part had talked about some issues of carrying behavior;and the last part talked something about the lethal weapon.The third part include three parts.Those parts had discussed the behavior setting and object of the steals.This paper want to combine with books,papers,and problems exist in the juridical practice,to explain some question.It has a certain significance for the application of the Amendment Ⅷ to Criminal Law.So it has its significance to study and report those problems.
