A Report On The Translation Of Crump V. Superior Court Los Angeles County

This report revolves around the translation of a judgement by the Court of Appeal of the State of California.The judgement deals with a case concerning compensation for environmental pollution in the United States.In China,such cases have become increasingly common.In this situation,this translation might provide some help for a deeper insight about how U.S.courts deal with such type of civil disputes and give reference to researches concerning similar judicial cases in China.With regard to guiding principles for translating this judgment,the author adopts those of Hans Kelsen and Susan ?ar?evi?,which are bipartite system and legal equivalence respectively.Based on bipartite system of legal texts,corresponding translation principles have been applied.As for descriptive parts,domestication and free translation will be utilized,while for prescriptive ones,foreignization and literal translation will be mainly used.Both the two genres of translation techniques aim to achieve legal equivalence.In case study section,problems have been summarized from two levels: lexicon and syntax.At the lexical level,the author has analyzed four kinds of problems,namely legal pairs,juxtaposition of noun synonyms,legal terms without established translations and repetition of legal terms.At the syntactical level,analysis has been made toward passive-voice sentences together with long and complex sentences.The author hopes that these efforts would offer help,if any,to those studying judgement translation and digging further in environmental pollution compensation cases under the U.S.judicial system.
