The rulers of Qin attach great importance to the legalist ideology and regard law as the main means of social governance.Therefore,this thesis takes the unearthed legal literature of Qin Dynasty as the main basis,and combines the relevant thoughts of the legalist doctrine in the handed down literature,so as to explore the family ethics in the legal thoughts of the Qin Dynasty.The full text is composed of three parts:introduction,body and conclusion.The introduction part mainly introduces the topic selection basis,research method,definition of major concepts and domestic and foreign research status of this topic.Chapters 1 to 4 make the main part of this paper.Chapters 1 to 3 respectively analyze the ethical concepts of father and son,husband and wife,master and slave.Chapter 4 discusses the background and purpose of the family ethics regulated by law in Qin Dynasty.The conclusion part is a comprehensive summary of this thesis.The main part of the text begins with the first chapter.This chapter takes the father and son's ethics in Qin Lu as the main object of investigation,and analyzes the legal status of father and son and the crime of "unfilial piety”in Qin Lu.Among them,the comparison of the legal status of father and son mainly focused on three aspects:the right of litigation of father and son,the power of punishment of father and the mutual infringement between father and son.The analysis of the crime of "unfilial piety" shows that this crime mostly refers to the disrespectful misdemeanors of inferiority in the family,so the connotation of "filial piety" is further expanded into a symbol of the status order in the family.The second chapter mainly takes the couple's ethics in Qin law as research object.Qin Dynasty confirmed the validity of the couple's relationship by legal means.Legal divorcement also means the dissolution of the couple's ethics.And Qin Lu severely punishes women for escaping marriage and committing adultery,which reflects the intention of maintaining marriage stability.In addition,from the perspective of the Qin law,whether it is criminal responsibility,kinship concepts or property rights,it reflects the ethical characteristics of husband-oriented and husband-worshiping.The third chapter mainly takes the master and slave ethics as research object,including the source and exemption of slaves,the living condition and legal status of slave slaves,also this chapter demonstrates the legality of private slaves in Qin Dynasty as family members in the ethical sense.The private slave-servant relationship in Qin Dynasty was not strict personal affiliation,which reflects the flexibility of the flow of social classes in the atmosphere of "work of merit".The fourth chapter focuses on the background and purpose of Qin rulers to promote family ethics by legal means.In terms of background,it mainly demonstrates the needs of the Qin Dynasty to change customs after political reunification,adopting the doctrine of legalists as an inevitable choice,and the ideal of promoting moral education by law.In the part of the implementation purpose,it mainly discusses three propositions:the priority of loyalty comparing to filial piety,the promotion of harmony between husband and wife,and the construction of a respectful order.
