Application And System Improvement Of DNA Identification Technology In Criminal Justice In China

In 1987,British police uncovered a case of rape and murder,which was successfully solved by the use of DNA identification technology,a new invention of geneticist Jeffreys.Since then,the field of criminal justice has entered a new era of DNA identification technology.In the past,biological evidence testing can only exclude suspects but can not be used to identify suspects in the field of criminal justice.The contribution of DNA identification technology lies in breaking through the bottleneck of "individualization of evidence",effectively establishing the relationship between evidence and suspects,and greatly expanding the scope of relevant criminal evidence that can be collected.In addition,DNA identification technology is obviously more stable and reliable than the testimony of suspects,defendants and witnesses.The continuous development of DNA identification technology provides strong support for identifying criminal facts and avoiding wrongful cases.Nowadays,the investigation of cases in the judicial field relies more and more on DNA identification technology,and DNA identification opinion is often used as the key evidence for court decisions.However,there are still many problems in the judicial identification of DNA evidence in our country,such as the irregularity of DNA evidence collection and identification,the formality of DNA evidence examination and identification,and the problems in the application of DNA database.These problems will result in some unreliable DNA evidence from unreliable sources and unreliable results being accepted by the court without standardized inspection,and the credibility of judicial expertise will be seriously damaged.Therefore,this paper explores the application and system improvement of DNA identification technology in criminal justice in China.The full text is divided into four parts:The first part is an overview of DNA identification technology.This paper summarizes DNA identification technology from three aspects:the scientific basis,concept and characteristics of DNA identification technology.The second part is the application of DNA identification technology in extraterritorial criminal justice.Including the common trend of application in common law countries,civil law countries and western developed countries.The third part is the application and deficiency of DNA identification technology in criminal justice in China.It includes the introduction and application of DNA identification technology in China,the inadequacy of DNA evidence collection and identification,the inadequacy of DNA evidence examination and identification,and the application of DNA database.The fourth part is the construction and improvement of DNA identification technology in China's criminal justice system.Including DNA evidence sampling and identification,DNA evidence review and identification,DNA database system construction and improvement.
