| China has a wide territory and a large of population,but the distribution of medicine resources is unbalanced.Along with the difficulty in attaching medical services and the high cost of medical environment in those years,people are not satisfied with Chinese medicine services.The rising of telemedicine can help alleviate the situation of the resources distribution in our country,and solve the difficulties in medical services.Telemedicine has developed in China for decades,in order to promote the telemedicine development,the government has issued many policies and regulations.However,although there are many literature researches about telemedicine in China,most of them just have a preliminary description,the implementation of telemedicine also faces a lot of policy and legal defects.The purpose of this article is to learn how order the policy and legal regulations in present heath care environment,and help Chinese telemedicine has a sustainable development.The article analyzes the problems existing in Chinese telemedicine by using different study methods.On the basis of the domestic medical environment and foreign telemedicine development experiences,the author puts forward some advices in the stewardship of Chinese policies and laws.This article mainly divides into four parts: First,has an overview of telemedicine,introduces the definition of telemedicine,analyses the necessity of the telemedicine development in China,then it has a brief introduction of telemedicine development,points out the importance of policies and laws.Second,by watching the existing regulations in China,points out Chinese telemedicine development has several deficiencies,health care systems,medical charges,service standards,information and privacy protection,legal liability provisions and so on.Third,through a vast amount of literature,learns the telemedicine experiences from Taiwan,the United States and Australia in policy and legal regulations,and makes an evaluation of their development.The fourth part,bases on the analysis of the lack of Chinese telemedicine,draw lessons from the United States and Taiwan telemedicine development model,argues that the development of telemedicine in China shall be conducted on the policy and legal regulation.First of all,in terms of health care system,the government should keep pace with the modern health system reform,telemedicine development should be coordinated with other reform measures,improve the utilization rate of the primary medical institutions and inspire the medical institutions and medical personnel to participate in the telemedicine treatment;Second,promote the government financial support,develop social medicine insurance and commercial insurance,improve the patient’s ability to accept the telemedicine services;Again,make telemedicine services standards,strengthen supervision,protect the legitimate rights and interests of each participant in telemedicine;Finally,at the perspective of law,determine the system about the legal liability distribution of telemedicine,resolve disputes about responsibility allocation by the ways of contract and legal regulations.Telemedicine development needs policy support,also legal protection.Besides the laws and policies,the telemedicine should also be adapted with the characteristics of humanism,to keep the balance of telemedicine development from the perspective of ethics.This article combines the knowledge of health management and law,fully analyzes the existing problems of telemedicine by integrating theory and practice,and incorporates the existing management and law theory,put forward strong recommendations for Chinese regulation of policies and laws,to move the rapid development of telemedicine in China. |
