| In 2018,China’s urbanization rate has reached 59.58%,41.66% higher than 40 years ago.The rapid urbanization process has a huge demand for land resources,which leads to the increasingly prominent contradiction between land development and rural land resource protection.As the basic means of production of food production,farmland is related to China’s food security and overall national security.China has formed the strictest farmland protection system in the world,especially the protection of basic farmland.In 1998,the state formulated the regulations on the protection of basic farmland to regulate the use of basic farmland,which played a positive role in ensuring the stability of food production and maintaining the quality of soil,but also made the right to development of land within the scope of basic farmland protection zone and the interests of farmers suffer losses.The more economically developed cities and regions,the greater the loss of farmers’ interests due to the right to land development.In this paper,literature analysis,questionnaire survey and other methods are used to carry out research and analysis.Firstly,the paper introduces the current situation of China’s basic farmland policy,the goal of basic farmland control and the relationship between farmland use control and farmland development rights and interests;secondly,it takes Guangzhou,a city with a high level of economic development,as a case study,introduces the distribution status,policy status,implementation status and compensation status of farmland use control in Guangzhou and analyzes its characteristics;studies the violations of basic farmland in Guangzhou According to the characteristics of legal behavior,this paper analyzes the illegal motives and actual needs of farmers;on the basis of the current research,a questionnaire is used to investigate 234 farmers’ cognition of farmland protection policies and farmland development authority,as well as the satisfaction of the interviewed farmers with farmland ecological compensation policies;combined with the current situation and the results of the questionnaire,the reasons for the loss of farmers’ interests,such as the basic farmland economy,are summarized The compensation standard is too low,and the dynamic adjustment of policy lags behind;the individual differences of farmers are ignored in policy making;land pollution and farmland occupation and compensation are not standardized,resulting in the decline of land capacity;land planning is not centralized enough and the transfer system of management rights is not perfect,which restricts the scale of agricultural operation;the development of agricultural finance and insurance industry lags behind.Finally,under the background that the basic farmland system restricts the right of farmland development,this paper proposes that the measures to protect the interests of farmers and the compensation measures should be considered as the supporting policies for the control of basic farmland use,and some suggestions for the optimization of farmers’ interests compensation policies should be put forward.The final conclusion is that to optimize the compensation policy for farmers’ interests,we need to start from the following aspects: establish and improve the evaluation mechanism of land development right income,accurately formulate the compensation standards and methods for farmers’ interests;determine the compensation standards and methods in combination with the local economic development level,farmland grade and other factors;establish and improve the dynamic adjustment mechanism of compensation standards,adapt to the circumstances,and adapt to the land Measures to be taken;long-term protection of farmers’ interests by improving their social security system,improving rural infrastructure,strengthening pollution prevention and control,and maintaining soil fertility;concentration of basic farmland and improvement of the transfer system of basic farmland management rights,through modern and large-scale management to improve the planting income;tapping the ecological value of basic farmland and optimizing Agricultural financing and insurance services. |
