Study On Legal System Of Forest Resources Use Regulation In China

The third plenary session of the 18 th Central Committee of the CPC proposed “ perfecting the regulation system for the use of natural resources”and the reform of the ecological civilization system put forward” Construct a system of territorial space development and protection based on spatial planning with use regulation as the main mean”.The report of the 19 th CPC National Congress further emphasized the implementation of the territorial space use regulation system.Forest resources play an irreplaceable role in natural resources.It is not only one of the most important resources in terrestrial ecosystem,but also has economic,ecological and social benefits.It undertakes the important task of providing forest products,ecological products and ecological services.And it affects the layout of urban and agricultural spaces.Strategic status is prominent.It is of great significance to regulate the use of forest resources,to ensure the legitimate and reasonable use of forest resources,to maintain the ecological balance,to ensure the harmony between human and nature,and to achieve sustainable development.However,at present,the regulation system of forest resources use in our country is not perfect,which embodied in the imperfect laws and regulations of use regulation,the lack of registration of forest resources use,the lack of Legal compulsion and connection with other resource planning in forestry long-term planning,and the improper classification and the degree of regulation in functional areas,use conversion mechanism is not standardized,the problem that supervision is not in place.The reasons for these problems are as follows: one is the lag in the construction of forest resources legal system in China;The other is the imbalance of the three benefits of forest resources;The third is the failure of the government's macro-control policy.In order to effectively regulate the use of forest resources,taking into account the typical models of forest management in the United States,Germany and New Zealand,and absorbing their advanced experience.Six suggestions are put forward to perfect the forest resources use regulationsystem in China: to amend the relevant legislation on forest resources,to replenish the registration of forest resources use,to standardize the long term forestry planning,to adjust the division of the zoning and degree of regulation,to strict restrictions on diversion and strengthen supervision.Only through the above measures can we implement the most stringent use control system for forest resources.Implementation of the strictest use regulation system for forest resources,standardize the use forest resources,guide the rational utilization and protection of forest resources in society,and promote the process of ecological civilization construction.
