Research On Risk Prevention And Control Of Contractor Under Fixed Price Comparison Mode

The Sichuan Provincial Government Investment Project Construction Project Comparison and Selection Method was formulated by the Sichuan Provincial Government in 2006 and revised in 2013.The Sichuan Provincial Development and Reform Commission has formulated the “Sichuan Provincial Government Investment Project Construction Project Fixed Price Comparison”.The method(Trial),the purpose of its method is to guide the project selection and selection activities of government investment projects,further guarantee the quality of construction projects,save costs and save time.Therefore,in practice,some government-invested projects in the province have adopted the above-mentioned comparison method for bidding.The bidding method does have its advantages,such as saving time,saving costs,and avoiding vicious competition.However,the construction of construction projects is not a simple “one-handed payment,one-handed delivery” behavior,which itself has certain complexity.The contractor is the contractor of the project and is responsible for the actual construction of the project.Under the fixed price comparison mode,the drawings Changes,changes in engineering volume,and soaring prices will cause corresponding problems and losses to the contractor,and at the same time,it will make it difficult to achieve the legislative goal of the implementation of the Fixed Price Comparison Option.Therefore,this paper studies the risk prevention and control of contractors under the fixed price comparison mode.The stratified analysis is used to quantitatively and qualitatively analyze the risk factors.The contractor’s risk is mainly concentrated in the terms stipulated in the fixed price contract.Through the analysis of the fixed price contract dispute cases,the risk factors specific to the fixed price contract are found out.The contractor should focus on the terms of the contract.Control according to different risk factors at various stages of construction,and propose solutions and corresponding recommendations.After a dispute arises,the contractor shall give priority to the treatment of the negotiation,and always insist on solving the problem as the starting point.While actively defending its own interests,it must reflect the sincerity of the consultation and make certain concessions if necessary.In addition,under certain circumstances,you may apply for arbitration or file a lawsuit in consideration of the applicable situation change principle.
