Research On Construction Contract Review Under The Mode Of Bill Of Quantities

With the further promotion of the domestic market bidding mechanism,the proportion of the valuation mode of Engineering quantity list is more and more large.Compared with the traditional mode,the construction contract under the mode of BOQ valuation means that the contract risks are shuffled by the Contracting Parties.Therefore,the review of construction contract under this model can’t be limited to the traditional review content and the depth of examination.For the contractor,how to protect their own interests by using the list pricing criterion,how to set up the risk of distribution contract and realize the final contract aim in such a valuation mode has become a proposition that can’t be neglected in the field of contract research.In the research frame,this article bases on the contract law theory,takes into account the real contract transaction process,breaks through the limitation which the legal personnel examines the contract,pays equal attention to "the specialized technology" and "the situation" in the contract examination thought.This paper examines the contract from the point of view of project management,starts from the work practice,interprets the contract principle,analyzes the influence of the valuation mode of the bill of quantities on the contract review,and pays close attention to the game state of the Contracting Parties,aiming at providing a new model and mechanism for the contract review within the construction.In the research process,the paper based on the influence of the valuation mode of the bill of quantities on the construction contract,analyzed and studied the examination of construction contract,on the contrary,the new examination thought and way fell on the contract price,and paid attention to the flexible essence of contract.By studying the influence of the valuation mode of the bill of quantities on the examination of construction contract,and combining with the principle and technique of the contractor’s contract review,the paper explores the model and mechanism of the internal contract examination of the construction enterprise.This article takes the project management as the angle to examine the contract,embarks from the work practice,the reinterpretation contract principle,the research project quantity list Valuation Model construction Contract examination strategy,to the legal personnel,the technical personnel,the management personnel in different level contract examination proposed the different emphasis and the examination strategy,The paper puts forward three suggestions on establishing contract Contracting Party review system,combining the review process of cost management and establishing contract template under the model of Bill of Quantities,which provides reference for the internal contract review mechanism and mode of construction enterprises.
