Research On The Pre-litigation Procedure Of Environmental Public Interest Litigation Of Procuratorial Organs In China

The establishment of environmental public interest litigation system in China's procuratorial organs plays an important role in promoting the development of ecological environmental protection.Judicial practice has proved that,as an important part of the system,pre-litigation procedure plays an important role in promoting the solution of problems that infringe on environmental public interests.It is not only an important part of the system but also an important means of implementing the system,and has become an important feature of the system of environmental public interest litigation in China's procuratorial organs.However,as China's public interest litigation system is still in the early stage of construction and the pre-litigation procedure system is not yet perfect,in-depth research on the pre-litigation procedure has important legal value and practical significance.This paper by procuratorial organs filed before litigation procedure of environmental public interest litigation system as the research object,from the perspective of the forms of legal supervision,v.announced before the characteristics and nature of the procuratorial advice before litigation,thus important conclusion,namely the design of such a system before litigation procedure is not only to fill the procuratorial organ in the absence of the law supervision and law enforcement supervision aspect,and played an important role in ecological protection for the environment,and possesses great value of the rule of law and realistic significance.On the basis of summarizing the status quo of the pre-litigation procedure,this paper analyzes the existing problems,by referring to the experience of the relatively representative environmental public interest litigation system outside China,and from the perspective of the legal supervision system of the procuratorial organs,puts forward Suggestions to improve the pre-litigation procedure of the environmental public interest litigation system of the procuratorial organs in China.
