Research On Water Rights Trading System Under The Background Of Ecological Civilization Reform

Since the reform and opening up,China's economy and society have developed rapidly and GDP has grown rapidly,but with it came a series of ecological problems.Especially in terms of the aquatic environment,China has paid a huge price.The shortage of water resources is prominent,water pollution is becoming more frequent,the aquatic environment is continuously deteriorating,and China 's water resources carrying capacity is obviously insufficient.Faced with this situation,saving water,optimizing water resource allocation,and improving water resource utilization have become urgent problems that China needs to solve at present.In January 2013,the Ministry of Water Resources issued the "Opinions on Accelerating the Construction of Water Ecological Civilization",which clearly stated that "encourage water rights transactions and use economic means to promote water conservation and protection." In 2015,the State Council issued the "Reform Plan for Ecological Civilization System"(hereinafter referred to as the "Overall Plan"),which further provided the theoretical direction and policy guidance for the construction of China's water rights system.Through the reform of the ecological civilization system,China's water rights trading system has been greatly developed,but there are still many problems that need to be analyzed and resolved.With the implementation of China's ecological civilization system reform policy,the academic research on water rights trading system still lacks the research on the impact of relevant system reform policies on water rights trading.And discussion,and comparative analysis of the current three types of transactions is less,so the lack of targeted questions and suggestions under each type of transaction.This thesis will analyze the water rights trading system in the context of the reform of the ecological civilization system through five chapters.The introduction of the first chapter elaborates the research background,research purpose,domestic and international research summary of water rights trading,and the research contents and methods of this article.The second chapter explains the concept of water rights and water rights trading.The theoretical basis analyzes the development process of the reform of the ecological civilization system and the six concepts,six principles,and eight systems in the "Reform Plan for the Ecological Civilization System".It also sorts out the development process of China's water rights trading system.Chapter Three starts with the three major types of water rights transactions in China,analyzes the differences between the three types in terms of transaction rules,lists representative transaction cases,and proposes the current existence of water rights transactions in accordance with the requirements of the reform of the ecological civilization system.The problem.In the fourth part,the author starts from the three countries of the United States,Australia,and Japan,analyzes the practical experience of foreign water rights transactions,and summarizes the facts that have arisen in determining water rights,giving play to market functions,and innovating water rights transaction forms.In the fifth part,the author puts forward suggestions from the aspects of cultivation,supervision,protection,and innovation of water rights transactions in light of the aforementioned problems and experiences.
