| Environment improvement is an integral part in economy and social development.In recent years,trans-boundary pollution is high,impacting the lives of ordinary people.Thus,a big challenge emerges in government powers.Regionalism cannot meet the demands of Chinese development.Together with the theories application,such as regionalism,regional integration is a trend in China.Regional environment protection from natural element,geographic location is better to achieve the aim of environment improvement.Administration protocol is the result of regional integration.Among the trans-boundary cooperation to improve environment,Chinese administration protocol in regional environment protection has become an important tool in regional environment cooperation.Environment administrative protocol is an administrative action among administrative main part to protect environment,largely applied in practice.But due to the influence of bureaucracy,and the late development of theory study of environment administrative protocol,nonstandard protocol procedure,clause hiatus,and inapparent effect are still there.The author put forward to relative methods through the analyses of current protocol text and operation,learning the successful lessons from other countries like USA.The article is divided into five parts:The introduction part analyzes the background of the research,present domestic and foreign research situation,the thinking and the main contents of the research and methods and innovation of the research.The article chapter one starts from the basic concept of environmental administrative agreement.Then it puts forward the concept,characteristics and classification of environmental administrative agreement by analyzing administrative agreement.It analyzes the function of environment administrative agreement combined with the suitable logic of administrative agreement and environmental governance.The second chapter analyzes the background and practice exploration of environmental administrative agreement.Then it discusses the content,procedure andactual effect of the agreement by the collection to the text and practice of the agreement.The third chapter puts forward the deficiency of the existing environment administrative agreement through the above research.Then it analyzes these problems that legal basis and the effect is not clear,concluding procedure is not democratic as well as the imperfect content provision and performance of the effect is not significant by analyzing the causes of the problem.The last chapter,according to the above problems,puts forward some countermeasures to the improvement of the environmental administrative agreement.Through studying the draw lessons from foreign experience,it puts forward establishing standard procedure,supplying legal basis,perfecting the content of the clause and guaranteeing to perform effect to solve the problems of environmental administrative agreement. |
