Demonstration And Expansion Of The Policy Environmental Impact Assessment System In China

The complete environmental impact assessment system should include the Project environmental impact assessment and the Strategic environmental impact assessment,among which the Strategic environmental impact assessment should be divided into the Policy EIA and the Plan EIA under the institutional context of our country.However,at present,China’s law only stipulates Plan EIA and the Project EIA,lacking the normative provisions for the Policy EIA.As an important tool for China’s administrative departments to perform their administrative functions,policy has an important impact on China’s economy and Society.At the same time,some policies have also caused far-reaching and extensive adverse effects on China’s ecological environment because they do not consider environmental friendliness when they are formulated.At present,China is in a period of high environmental risk.In the face of very urgent ecological and environmental pollution problems,there is an urgent need to establish Policy EIA system to ensure that policy making is environmentally friendly and to improve the quality of decision-making.Based on a basic overview of Policy EIA,this paper reviews the current institutional resources of Policy EIA in China.Combined with the history and current situation of our country,it demonstrates the necessity and feasibility of constructing the Policy EIA system in China’s legal level.From the perspective of the evaluation object,related subject and basic procedure of Policy EIA,this paper puts forward the concrete proposal to our country to establish this system.This article consists of four parts besides the introduction and the conclusion:The first chapter named "Overview of Policy EIA" mainly discusses the connotation of Policy EIA,and discusses the concept,characteristics and functional value of Policy EIA.The second chapter named "Combine and review the current institutional resources of Policy EIA" is mainly divided into two sections.The first is to sort out and review the lack of Article 14 of the Environmental Protection Law at the national level.The second is to sort out and review the "Shenzhen Special Economic Zone Environmental Protection Regulations" at the local level.The third chapter named "The evidence of the construction of China’s Policy EIA" outlines the necessity of constructing the Policy EIA system from three perspectives of the historical lessons of adverse environmental impacts caused by some policies,the realistic needs of risk society and the theoretical needs of improving the strategic environmental assessment system;Demonstrating the feasibility of establishing the system from the construction of China’s ecological civilization to provide a favorable opportunity,major administrative decision-making procedures and lifelong accountability system to form a wide range of demand opportunities and ecological and environmental protection departments have explored and summarized the basic mode and method through the Policy EIA Pilot Study.The fourth chapter named "The development of China’s Policy EIA system",this paper discusses the construction of Policy EIA system in China from the three aspects of the evaluation object,related subjects and basic procedures.
