Study On The Legislation Of The Treatment Of Municipal Black And Malodorous Water

Municipal black and malodorous water bodies exist in the built-up areas of cities above the prefecture level.Due to water pollution or ecological damage,they present unpleasant colors and/or emit unpleasant odors.Compared with the general legislation of water pollution prevention and control,the legislation of municipal black and malodorous water treatment has its own characteristics.First,the measures are systematic.Legislation on municipal black and malodorous water governance requires not only "emission reduction",but also "capacity increase".Second,the subject is pluralistic.The main body involved in the legislation of municipal black and malodorous water governance is not a single enterprise,peasant household and other polluters,nor a single government or a government department,but a multi-subject of government,enterprises,peasant households and the public.Third,the effect is persistent.The legislation of municipal black and malodorous water treatment should first control the black and malodorous water body.On the basis of completing the preliminary purification,we should ensure the continuity of the treatment effect,prevent the rebound of black and malodorous water body,and achieve long-term governance.At present,it is necessary and feasible to legislate for the treatment of municipal black and malodorous water.On the one hand,it is necessary to legislate for the treatment of municipal black and malodorous water.The reason is that the current special legislation for the treatment of municipal black and malodorous water is still lacking,the legal principles for the treatment of municipal black and malodorous water have not yet been established,the basic legal system for the treatment of municipal black and malodorous water is not perfect,and the supporting legal system for the treatment of municipal black and malodorous water is not perfect.On the other hand,the legislation of municipal black and malodorous water treatment is also operable in practice.First of all,there is a clear basis for the upper law,and the legislation clearly puts forward the legislative requirements of "regulating the black and malodorous water body".Secondly,a series of policy documents including "Ten Rules of Water" and other policies for municipal black and malodorous water remediation have been issued.Thirdly,we can draw lessons from the experience of legislation on the treatment of black and malodorous water in foreign cities.The advanced experience of Japan,Britain,Korea,Germany and other countries in the process of water control provides important enlightenment and reference for our cities to carry out the legislation on the treatment of black and malodorous water.At the same time,there are abundant practical experience of municipal black and malodorous water treatment to provide legislative needs,legislative focus and legislative difficulties.It is suggested that the legislation of the treatment of black and malodorous water body should be at the level of prefecture and above,and the "one city,one law" should be implemented.On this basis,the special legislation of the treatment of municipal black and malodorous water body should be realized.Secondly,in the legislation of black and malodorous water treatment,four legal principles of municipal black and malodorous water treatment are clarified,including government-led principle,department cooperation principle,public participation principle and system governance principle.Thirdly,we should improve the basic legal system of municipal black and malodorous water treatment,including the system of black and malodorous water body directory,the system of government responsibility allocation,the system of black and malodorous water body improvement plan and long-term management plan,the system of water quality monitoring,the system of source control and the system of black and malodorous water system regulation.Finally,we should improve the supporting legal system of municipal black and malodorous water governance,including law enforcement coordination,collaboration system,complaint reporting system,third-party evaluation system,investment system and government accountability system.Among them,the government accountability system includes four main contents: target assessment,interview,notification and criticism,and administrative responsibility.
