Analysis On The Development Of Statute Of Chinese Environmental Protection NGO As A Subject In Environmental Nonprofit Litigation

Revised Environmental Protection Law of The People' s Republic of China has explicitly defined the legal subject of environmental protection non-government organizations(NGO)in China.In this paper,the statute of environmental protection NGO as a subject is regarded as a legal issue to investigate its development course and current situation.The present paper consists of five parts including introduction,environmental nonprofit litigation and its current status,environmental protection NGO and environmental nonprofit litigation,the unsuccessful development of the principal status of environmental protection NGO in China as well as the further function of environmental protection NGO in litigation field.Based on the most fundamental theoretical basis for the generation of environmental protection NGO,with the revised Environmental Protection Law of The People' s Republic of China as the research background,some research achievements and individual opinions about the development course of the capacity of environmental protection NGO as a subject of law are elaborated according to the primary data of scholars.The improved capacity of environmental protection NGO contributes to improving the current status,which is reflected in three aspects,with laws as the protection.Government offices are required to constantly perfect systems related to environment,creating a better environment for the development of environmental nonprofit litigation.Meanwhile,legislation,administration and judiciary authorities should actively cooperate with each other to function,get Rechtsfortbildung realized and offer concrete assistance.Additionally,environmental protection NGO should enhance their own construction,expand source of fund,and improve expertise.Finally,the public should take an active part and make corresponding contributions,thus creating the pattern of joint development..
