Research On The Connection Between Administrative Responsibility And Criminal Responsibility Of Environmental Pollution

In the 8th Amendments to the Criminal Code,serious environmental pollution accident crime amended as environmental pollution crime,which becomes a legal offense according to relevant judicial interpretations.There is a close relationship between the criminal law and the administrative law.The administrative responsibility for pollution is a much wider range of criminal responsibility.Therefore,it is necessary to study the boundaries between criminal responsibility and administrative responsibility.In this paper,the environmental pollution of the illegal behavior is the object of study.The author study the distinction between the administrative violations and the crime of environmental pollution.The author first introduced the criminal and administrative legislation of the environmental pollution and the experience of foreign legislation.And then,from the perspective of criminal law,the author analysis the specific situation of convergence.After that,the author summarize the problems and list them in three aspects-criminal law,administrative law and the connection.At last,the author make some suggestions.This paper perhaps can provide some reference for the study of the connection between administrative responsibility and criminal responsibility in other fields.
