Research On Legislation Of Indoor Decoration Pollution In China

With the improvement of people's material living standards,the people pay more and more attention to the comfort of the house.Many families have begun to spend a lot of money on the renovation of their homes,but they have neglected the hidden factors behind the decoration materials market.After the interior decoration,the smell is large,and in special weather,the release of harmful substances will be accelerated.This effect is long-term and difficult to remove.People who stay indoors for too long are vulnerable to infringement.In recent years,the number of cases of illness caused by indoor decoration pollution has gradually increased,and it has been difficult for victims to get the necessary relief when they resort to the court.The main reason is that indoor decoration pollution is a new type of environmental pollution,and the legislation is lagging behind,so that there are various treatment methods for indoor decoration pollution disputes in judicial practice.At the same time,due to the late study of indoor environment in China,the relevant standard systems are not perfect,and the indoor environmental health of residents is not guaranteed.The current situation of indoor environment is really worrying.This paper attempts to analyze and analyze from four aspects.The first part is the introduction,which mainly introduces the key points of this paper through specific case analysis,that is,indoor decoration pollution is difficult to identify as environmental infringement;the principle of inversion of burden of proof is difficult to apply;the causal relationship between harmful substances exceeding the standard and disease is difficult to identify;Difficulty.In this part,the domestic and international research status of the indoor environment is described to facilitate understanding of the current indoor environment.At the same time,it puts forward its own research ideas and research methods for the indoor decoration pollution problem discussed in this paper.The second part deals with the concept of interior decoration pollution.Clarify the basic concept of indoor decoration pollution,analyze whether indoor decoration pollution is environmental infringement,and compare the indoor decoration pollution infringement liability with relevant legal responsibilities to further understand the nature of indoor decoration pollution.The third part lists the relevant laws and regulations on indoor decoration pollution in China and summarizes the four legislative issues facing the interior decoration pollution in China.The first is that there is no special indoor decoration pollution prevention and control law in China;the second is indoor air.The quality standard is not perfect;the third is thedifficulty in identifying the infringement of indoor decoration pollution in China;the fourth is that the indoor environmental inspection system is not standardized.The fourth part is to propose corresponding solutions to the legislative issues analyzed in the previous article.I believe that,first,we must clarify the legal status of the indoor environment in the Environmental Protection Law and formulate a special law on indoor air pollution prevention and control.Indoor air quality standards;Third,determine the identification of indoor decoration pollution infringement liability,determine the causal relationship;Fourth,establish and improve the indoor environmental quality testing system.
