| In accordance with the requirements of the 19th National Party Congress,in the next three years,we must focus on the three major challenges of defeating major risks,achieving poverty alleviation,and preventing and controlling pollution.Xi Jinping clearly stated in the report of the 19th Party Congress that "providing more quality ecological products to meet the people’s growing beautiful ecological needs." A good eco-environment is the fairest public product,and it is the most well-being of people’s well-being.With the continuous advancement of ecological civilization construction in the new era,people are paying more attention to environmental pollution control and green development.The traditional pollution control model has failed due to the ossification of the administrative supervision level,the weakening of the environmental legal system,and the strengthening of the economic transformation.In recent years,China has introduced third-party governance in the field of environmental pollution as a contractual system that provides environmental ecological public goods.It is a product of the combination of contractual thinking and governance theory in the new public management theory.This new governance mechanism provides new ideas and new opportunities for environmental pollution treatment.After the introduction of third-party governance,environmental pollution control has been freed from the "government-enterprise" dualistic model and the"command-control","standard-compliance," and "illegal-penalty" one-way approach,which is helpful to build a modern environmental governance system that is government-led,enterprise-based,social organization,and public participating.However,environmental pollution third-party governance has seen a series of risks and dilemmas such as ambiguous subject liability boundaries and insufficient risk management capabilities.Based on the typical case of third-party water pollution control in small watersheds in Yanping District in Nanping City,Fujian province.,this paper combines field research and studies on contract conclusion process,contract implementation effectiveness and contract liability dilemmas of third-party governance,and proposes corresponding countermeasures against existing risks and dilemmas.With the hope to provide useful inspiration and lessons for local governments to better promote the use of third-party governance. |
